What is an Independent Security Survey?
In 1984, the Internal Revenue Code was amended to include the term “fringe benefits” in the definition of gross income where security must be treated as compensation unless there is a specific statutory exclusion that applies to the benefit. This exclusion applies if a “bona fide business-oriented security concern” exists and facts + circumstances establish a basis for concern regarding the safety of an employee. It goes further to state, no bona fide business-oriented security concern will exist unless the employer establishes an “overall security program” and conducts and implements an “independent security study” with respect to the employee involved where security is provided to protect the employee on a 24-hour basis. Reg. § 1.132-5(m)(2)(iv).
